What is the Children’s Promise Act?
“The Children’s Promise Act” provides a dollar-for-dollar TAX CREDIT to businesses that give to a qualified Education Services Charitable Organization (ESCO).
The Mississippi “Children’s Promise Act” is a Mississippi law that was passed by the Mississippi legislature in 2019 that allows Mississippi business organizations to file an application for a tax credit against their Mississippi corporate income tax, with the amount of tax credit approved by Mississippi Department of Revenue then contributed to an approved Educational Services Charitable Organization (ESCO). Manchester Academy has been granted approval as a designated ESCO by the Mississippi Department of Revenue.
What does the Children’s Promise Act allow my business to do?
Under this legislation, Mississippi businesses that have Mississippi corporate income tax liability fill out an application for a tax credit against the taxes owed to the Mississippi Department of Revenue. There is a statewide cap of the amount that will be approved by the Department of Revenue so the program operates on a first come, first serve basis. Once the statewide cap is reached, no more applications will be approved.
Who can make contributions?
The tax credit is only available to a taxpayer who is a business enterprise engaged in commercial, industrial, or professional activities and operating as a corporation, limited liability company, partnership, or sole proprietorship. Taxpayers may utilize the credit against income tax, insurance premium tax, and insurance premium retaliatory tax. Taxpayers, not operating as a corporation, may also utilize the credit against ad valorem taxes on real property (land owners).
How much tax credit am I allowed?
A business can receive a dollar for dollar tax credit for up to 50% of its tax liability for the given year.
Individuals can claim a tax credit of up to 50 % of their donation, with the maximum credit capped at $1,000 for individuals and $2,000 for married couples filing jointly.
When do I pay the contribution to Manchester Academy?
By law, after a business operating in Mississippi receives their approval of their application for a specified tax credit allocation, the approved business operating in Mississippi has 60 days to pay the ESCO (MA) the charitable contribution amount equal to the amount of the tax credit allocation amount approved by the Department of Revenue.
STEP 1
Complete the online application.
Apply for a Charitable Contribution Credit
Within 30 days of receipt, MSDOR shall send notification of allocations.
STEP 2
Make a donation to Manchester Academy to receive a dollar for dollar tax credit through the Children’s Promise Act.
STEP 3
Send receipt/verification of donation to the MSDOR. Verification must be received within 60 days of receipt of notification of allocation.
